Welcome to Roadsider. These Terms of Service ("Terms") constitute a legally binding agreement made between you and Roadsider concerning your access to and use of our website, as well as any other media form, media channel, or mobile application (including the Google Play Store and Apple App Store versions) related, linked, or otherwise connected thereto (collectively, the "Service").
By accessing or using the Service, you signify your agreement to these Terms. If you do not agree to these Terms, you may not access or use the Service.
1. The Roadside Service Platform
Roadsider provides a software platform designed to facilitate roadside assistance operations. We offer software solutions for towing companies, dispatchers, mechanics, and consumers. Roadsider does not directly provide towing or physical roadside assistance services; we simply provide the digital infrastructure to connect and manage these services.
2. User Accounts & Registration
To use certain features of the Service, you may be required to register for an account. You agree to:
- Provide true, accurate, current, and complete information about yourself as prompted by the registration form.
- Maintain and promptly update your registration data to keep it accurate and complete.
- Be responsible for maintaining the confidentiality of your password and account.
- Notify us immediately of any unauthorized use of your account or any other breach of security.
3. Mobile Application License & App Store Terms
Subject to your compliance with these Terms, Roadsider grants you a limited, non-exclusive, and nontransferable license to download and install a copy of our mobile application on a mobile device that you own or control.
App Store & Google Play Dependencies: You acknowledge that these Terms are concluded between you and Roadsider only, and not with Apple Inc. or Google LLC. Roadsider is solely responsible for the application and its content. Neither Apple nor Google has any obligation whatsoever to furnish any maintenance and support services with respect to the application.
4. Acceptable Use Policy
You may not access or use the Service for any purpose other than that for which we make the Service available. You agree not to:
- Systematically retrieve data or other content from the Service to create or compile a collection, compilation, database, or directory without written permission from us.
- Make improper use of our support services or submit false reports of abuse, misconduct, or fake roadside service requests.
- Interfere with, disrupt, or create an undue burden on the Service or the networks or services connected to the Service.
- Upload or transmit any viruses, Trojan horses, or other material, including excessive use of capital letters and spamming, that interferes with any party's uninterrupted use and enjoyment of the Service.
5. Intellectual Property Rights
Unless otherwise indicated, the Service is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Service (collectively, the "Content") and the trademarks, service marks, and logos contained therein are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.
6. Disclaimer of Warranties & Limitation of Liability
THE SERVICE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICE WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICE AND YOUR USE THEREOF.
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
7. Account Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If your account is terminated due to violations of these terms or fraudulent activity, you may be permanently blocked from using our applications and network platform.
8. Governing Law
These Terms shall be governed by and defined following the laws of your operating jurisdiction. Roadsider and yourself irrevocably consent that the courts of that jurisdiction shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
